Practice Direction # 3 – Electronic Filing and Service of Documents

Practice directions help parties understand the rules and procedures of the Transportation Appeal Tribunal of Canada (the Tribunal). 

1.    Purpose

1.1    The Tribunal tries to be as flexible as possible with its filing process and provide parties with the opportunity to submit documents in a quick and efficient way.

1.2    The traditional rules for the filing and service of documents are set out in sections 5 to 8 of the Transportation Appeal Tribunal of Canada Rules. These rules do not provide for electronic filing (e-filing) and service of documents.

1.3    This practice direction aims to help parties file and serve documents electronically. It applies to all proceedings before the Tribunal, for all types of files (including medical files), and at both the review and appeal levels. 

2.    How to file documents?

2.1    The Tribunal uses an online Secure Repository System (SRS) for e-filing. When a party submits documents through the SRS, the Registry will review and process them and make them available to the other party. All documents remain accessible in the SRS until the file is closed. 

2.2    Instructions on how to create an account and use the SRS are provided to parties once a new file is opened. Upon the opening of a file, parties can also register for an account directly at https://e-registry-registre-e.tatc.gc.ca/registerProfile-eng.aspx

2.3    Documents submitted through the SRS are not considered filed until they have been processed by the Tribunal Registry. Once processed, the documents are considered filed as of the date they were submitted. If the submission occurs after 5:00 p.m. (ET) or on a holiday, it will be considered filed on the next business day.

2.4    A document is considered served on the date it is sent by the Tribunal Registry to the parties through the SRS. Parties will also receive an email notification when documents are shared by the Registry.

2.5    The Tribunal strongly recommends that parties use the SRS to file their documents. However, a party can also submit documents by email at Registry-Greffe@tatc.gc.ca.

2.6    Documents sent by email are considered filed on the date they are received at the Registry’s email address, unless the submission is received after 5:00 p.m. (ET) or on a holiday. In such a case, the submission will be considered filed on the next business day.

2.7    If a party chooses to submit documents by email, that party must provide the Tribunal with proof of service on the other party. To do so, we recommend copying the Registry on the correspondence to the other party.

3.    When to file documents?

3.1    The respondent must file all documentary evidence they intend to rely on at the hearing no later than 10 business days before the hearing.

3.2    The applicant is not required to give evidence or testify. However, if the applicant chooses to do so, they can submit documentary evidence either before or during the hearing.

3.3    Parties are encouraged to file documents with the Tribunal through the SRS, where they will be made accessible to both parties.

3.4    In preparation for the hearing, parties can submit potential exhibits to be entered as evidence. However, these must be introduced during the hearing to be added to the Tribunal record. Potential exhibits that are not introduced as evidence during the hearing do not form part of the Tribunal record.
