Practice Direction # 1 – Form of Hearing

Practice directions helps parties understand the rules and procedures of the Transportation Appeal Tribunal of Canada (TATC or the Tribunal).

1. Purpose

       1.1 The purpose of this practice direction is to explain the various forms of hearings conducted by the Tribunal.

       1.2 The Tribunal tries to be as flexible as possible in its procedures. It aims to give the parties the opportunity to present their case in a fair and efficient manner.

       1.3 Members of the public who want to attend a hearing may consult the TATC Hearing Schedule on the Tribunal’s website.  

2. Virtual hearings

       2.1 By default, the Tribunal conducts its hearings virtually (by videoconference) using the Microsoft Teams platform. Virtual hearings make justice more accessible, and this format also enables the Tribunal to be fairer, more effective, and more efficient.

       2.2 Parties must use their own computer, smartphone, or other device in an appropriate location to connect to the virtual hearing. If a party does not have access to a computer or other device, the Tribunal’s Registry must be notified in writing as soon as possible so that it can assist in making the necessary arrangements.

3. In-person hearings

       3.1 A party may request an in-person hearing by submitting a written request to the Tribunal’s Registry. The request must explain why an in-person hearing is necessary, and why a virtual hearing would not be fair.

       3.2 The request must be made as soon as possible and should be addressed to the Chairperson of the Tribunal.

       3.3 The opposing party will have the opportunity to review the other party’s request and will have five business days to submit its own comments to the Tribunal. Even if the opposing party agrees with the other party’s request, it is up to the Tribunal to grant or deny the request for an in-person hearing.   
       3.4 After considering the circumstances and the submissions of both parties, the Chairperson will make a final decision on the form of hearing.

       3.5 All travel expenses will be covered by each party. The Tribunal will pay for the hearing room and some other direct costs associated with an in-person hearing.
